This article argues that New Zealand employers should be subject to mandatory pay transparency as a means of addressing the gender pay gap. This would help employers to comply with their legal obligations not to discriminate against women, and it would aid in the enforcement of the law. It would also ameliorate inequality of bargaining power and encourage employers to appoint and promote based on legitimate criteria. The article also provides some
recommendations to guide the design of an optimal pay transparency regime; it should be universal and accessible, with penalties and incentives around both reporting and improving performance.
